Biographical Note
Everett E. Ellinwood
Everett E. Ellinwood was born July 22, 1862, in Rock Creek, Ohio. He attended Knox College
from 1882-1885 and took the law course at the University of Michigan shortly after. He was
admitted to the bar of Illinois in 1889 and moved to Flagstaff the following year, where he
engaged in private practice for three years. In 1893, President Cleveland appointed
Ellinwood to the US District Attorney for the Arizona Territory, a position Ellinwood
retained until 1898. During his tenure as District Attorney, Ellinwood located both his home and office in
Tucson. Following his return to private practice, Ellinwood successively had offices in
Flagstaff, Tucson, Prescott, Bisbee, and Phoenix. In 1905, the law firm of Hawkins,
Ellinwood, and Ross was formed in Prescott by John J. Hawkins, John Mason Ross, and
Ellinwood. The following year Ellinwood assumed duties as general attorney for the Phelps
Dodge industrial and mercantile interests in Arizona and New Mexico, which included the
Copper Queen Consolidated Mining Corporation and Store.
Ellinwood left the firm in 1907 to move to Bisbee and was joined there by Ross in 1910. It
was then that the firm of Ellinwood and Ross was formed. A previous firm, Hearring, Sorin,
and Ellinwood reached it dissolution in January 1909, however Ellinwood remained in close
contact with all of his former law partners. Ellinwood and Ross continued on in Bisbee until
1929 when the main office was moved to Phoenix. A branch office continued in Bisbee until
1935. Other prominent clients included the El Paso and Southwestern Railroad Company, the
Model Gold Mining Company, W. H. Taggart Mercantile Company, Babbitt Brothers Mercantile
Company, and the Arizona Lumber and Timber Company.
Ellinwood considered himself a conservative Democrat and his influence in the political
concerns of pre-statehood Arizona are not inconsiderable. He was a delegate to the
Democratic National Convention in 1892 and was chairman of the Democratic Territorial
Committee in 1900-1902 and 1904-1906. He was a significant force in the writing of the state
constitution at the Constitutional Convention in 1910 but declined to sign the final
document due to its allowing for the recall of the judiciary. In 1926, Ellinwood was an
unsuccessful candidate for governor.
Additionally, he served as president of the Phoenix National Bank and the Phoenix Savings
Bank and Trust Company. From 1897 to 1911, he was Arizona Commissioner for the promotion of
uniform laws in the United States. He also served two terms on the University of Arizona's
Board of Regents. His son Ralph E. Ellinwood eventually was a partner with William R.
Mathews int he purchase of the Arizona Daily Star from Phelps Dodge in 1923 and acted
as its editor until his death at the age of 37 in 1930. E. E. Ellinwood died of a chronic
heart ailment in his Tucson home on August 8, 1943.
John Mason Ross
John Mason Ross was born in Davis County, Indiana in 1874. He graduated from Stanford
University in 1897 and engaged in private practice in California for three years until
relocating in Prescott. There, Ross associated himself with John J. Hawkins, following which
Ross became a partner in Norris, Ross, and Smith. In 1905, Hawkins, Ellinwood, and Ross
formed in Prescott. When Ellinwood accepted the duties of general counsel to Phelps Dodge,
he left and the firm moved to Bisbee. The task as counsel to Phelps Dodge was a complex one
and in July 1910, Ross joined Ellinwood in Bisbee and in partnership. Ross followed
Ellinwood from Bisbee to Phoenix in 1929 and remained there until Ellinwood's death in 1943.
J. M. Ross died of a heart attack in Laguna Beach, California, on August 2, 1944.
Scope and Content Note
Correspondence and legal case files, 1893-1917, relating to the career of Everett E.
Ellinwood, John Mason Ross, and their law firm Ellinwood & Ross. Ellinwood's personal
correspondence only encompasses 1906-1908, while Ross' is from 1906-1917. Business
correspondence dates from 1898-1917, and includes legal concerns from their separate
practices, as well as the firm. Selected political correspondents are George W.P. Hunt,
Joseph H. Kibbey, and Marcus A. Smith. Selected lawyer correspondents are Richard E. Sloan
and Thomas J. Norton. Case files include general files and El Paso and Southwestern Railroad
files. The records are fragmented and do not cover all aspects of their careers.

Series I consists of correspondence that has been divided into three subseries.
Subseries 1 includes E. E. Ellinwood's personal correspondence, which details his
opinions in letters to and from several leading figures in the political arena. His
family life is represented by a number of letters to and from the headmasters of the
schools in which his son, Ralph, was enrolled. Additionally, Ellinwood's personal
business correspondence is filed here.
Subseries 2 includes the personal correspondence of John Mason Ross. Represented here
are letters to and from friends and family plus a number of letters dealing with
political interests of the state, and to a lesser extent, on a national level. Previous
law partners, college friends, and fraternity brothers are also represented, as are
letters dealing with his legal work outside of the firm and Ross' financial concerns in
assorted stock and mining ventures.
Subseries 3 includes ongoing business concerns of the firm Ellinwood and Ross. Files
predating the firm deal with legal concerns handled by both Ellinwood and Ross are
included. There is also correspondence between the Bisbee and Tucson offices of Herring,
Sorin, and Ellinwood.
These records are fragmented and do not cover all aspects of either Ellinwood or Ross'
career, nor are they a complete representation of the years 1906-1910. Also not
represented are the records from Ellinwood's tenure as US District Attorney or the
University of Arizona's Board of Regents.
This subseries includes holographic and typewritten correspondence to friends,
family, political contacts, business concerns and private legal consultations
including requests for transcripts of cases and opinions as well as concerns for the
disposition of effects as executor of an estate. Political correspondents include
Joseph H. Kibbey, Governor of the Arizona Territory, regarding the statehood fight and
a proposed bullion tax bill, Geroge W. P. Hunt, Marcus A. Smith, John Whiteside, and
Judson Harmon, Governor of Ohio. Morris Goldwater corresponds with Ellinwood regarding
the possible parole for a prisoner in the Territorial Prison. Additional
correspondents include fellow lawyers, T. J. Norton, J. M. Ross, F. W. Sisson, and
Richard Sloan. Correspondence regarding the selection of delegates to the National
Democratic Convention is also represented.
This subseries contains letters to and from individuals detailing the political
climate of the state. Samuel Platt, the deputy secretary of state of Nevada, makes
many inquiries of Ross and encourages him to seek a seat in the US Senate. His reply
is candid in answering Platt's questions. Herbert Whitton, court reporter for Napa and
Sonoma counties in California, corresponds on matters regarding prohibition,
bootlegging, and the Industrial Workers of the World, and "the Bisbee method" of
dealing with striking miners. Ross, unlike Ellinwood, was a Republican and there is
correspondence dealing with the state and national Republican Party. In addition,
Ross' private legal correspondence outside of the firm is filed here. The major
correspondents include Hugh Brown, Olaf Longacre, T. J. Norris, and Frank Smith.
This subseries includes correspondence, telegrams, and papers relating to the general
operation of the firm including those dealing with the taking of depositions, evidence
submitted, plea bargains, case extensions, taxes, rental properties, and
naturalization difficulties. Additionally, correspondence to and from previous law
firms, former law partners and businessmen is included. The larger files here are
Walter Douglas, S. W. French (General Manager of the El Paso and Southwestern
Railroad), W. H. Brophy (General Manager of the Copper Queen Consolidated Mercantile
Company), W. B. Kelly, Alfred Lockwood, and Reese Ling. Major clients such as the
Babbitt Brothers Mercantile Company and the Model Gold Mining Company are represented
as well as minor clients and supporting companies such as the Gibson Abstract Company.
Of interest is a Code Book which was used in the telegraphic transmission of coded
messages relating to business interests. Interspersed throughout the business
correspondence are various coded telegraphs, some of which are partially
translated.

Series II consists of case files Ellinwood and his partners worked on during their
legal careers. Subseries 1 includes information relating to the El Paso and Southwestern
Railroad Company. Most notable in this series are the two folders dealing with the
miners' strike in Bisbee in 1907.
Subseries 2 includes general case files, which makes up a majority of the collection.
Topics in these files include right-of-way concerns, writs of garnishment, disputes on
freight charges and damaged contents, suits filed by ejected passengers, plus a suit
against the railroad for violating the Safety Appliance Act of 1893, which prohibits the
moving of railroad cars with damaged coupling mechanisms.
These records are fragmented and do not cover all aspects of either Ellinwood or Ross'
career, nor are they a complete representation of the years 1906-1910. Also not
represented are the records from Ellinwood's tenure as US District Attorney or the
University of Arizona's Board of Regents.
This subseries includes case files, legal papers, and correspondence relating to the
legal interests and concerns of the El Paso and Southwestern Railroad Company
(EPSWRR). Most notable are files concerning the lawsuit against the Bisbee Miners
Union on regard to a 1907 strike. Orders to desist picketing, correspondence, fliers
and broadsides are located in these files. The regular order of business is detailed
in the remainder of the case files which concern the garnishment of wages, railroad
right-of-ways, suits resulting from deaths related to the railroad, complains of lost
baggage and damaged freight, suits brought by ejected passengers, and a suit brought
against the company for violating the Safety Appliance Act. Cases are arranged
alphabetically by plaintiff's last name.

Cattle Company, Babbitt Brothers Mercantile Company, Bank of Bisbee, Bank of Douglas,
City of Bisbee, Haywood Cattle Company, Model Gold Mining Company, Santa Fe Pacific
Railroad Company, W. H. Taggart Mercantile Company, etc. These cases concerned
bankruptcy pleadings and cases, depositions, evidence, case extensions, demurrers and
injunctions. Various individuals also consulted with the firm on such issues as
divorces, garnishment of wages, wrongful death suits, right-of-ways, and
